| 1. DEFINITIONS |
| 1:1 The following definitions apply unless inconsistent with the text :

- BuggyMart means BuggyMart limited, registered office address PO Box 007, England.
- Entry Fees and Commissions means the Fees and Commission payable for the listing of goods for sale, auction or wanted.
- Conditions means the standard terms and conditions of business as set out in this document.
- Lot Numbers relate to the reference number allocated to any item submitted and advertised for sale, wanted or to be auctioned in accordance with these conditions.
- Purchaser or bidder means a person, company or firm who purchase advertised entries on the BuggyMart website.
- Seller means any person, company or firm who place items for sale or wanted on the BuggyMart website.
- BuggyMart website means the website found at www.buggymart.com and variations of the same URL.
- Successful bid means the final bid price of the item, but not necessarily a bid we guarantee the seller will accept.

1:2 Except where the context otherwise requires words denoting the singular, include the plural and visa versa: words denoting one gender include all genders: words denoting persons include corporations and visa versa.

| 2. REFUSAL OF ENTRY |
|
2:1 BuggyMart may without giving reason, refuse to accept any item for inclusion on their website or remove the entry without giving reason if it is felt grounds exist to do so.

| 3. BIDDING |
3:1 The prospective buyer can bid on line as many times as they wish, each time an
increase in price on the previous bid.
3:2 No bids are accepted after the bidding closes.
3:3 By registering on line and making bids, the prospective buyer agrees to be honourable in their intentions and work towards bringing the transaction to a swift conclusion and payment.
3:4 No person shall advance less at a bid than a sum determined by the increment shown on the auction page at that time for that particular item.

| 4. CURRENCY |
4:1 Both the auction and sale price of goods are shown in the preferred currency of the advertiser. This is the currency in which they want to receive payment. Please look carefully and take note before bidding.

5:1 Whilst every possible care is taken to ensure information on this website is accurate and up to date, the information and services published may include inaccuracies or errors. BuggyMart makes no representations about the suitability of the information and services contained on this web site for any purpose. All such information and services are provided 'as is' without warranty of any kind.

6:2 BuggyMart shall not be responsible for any expense, loss, claim or proceedings in any respect of any loss or damage whatsoever to any property real or personal whether incurred before, during or after the transaction is complete.
6:3 BuggyMart shall not be liable for any expense, loss or claim or proceedings in any respect of personal injury to or death of any person arising out of or in the course of or caused by the sale.
6:4 It is the bidder's responsibility to make sure the goods meet all health and safety regulations relevant to the bidders intended use, prior to putting the item to use.

| 7. PAYMENT |
|
7:1 Upon making a purchase, the successful buyer shall make a full and prompt payment to the seller and remove the goods from the sellers premises in a prompt efficient manner all in accordance with the sellers conditions.

| 8. DESCRIPTION OF GOODS |
8:1 No warranties are given or implied by BuggyMart in relation to any item(s) offered for sale or wanted.
8:2 All advertisement or link descriptions are those of the seller or advertiser alone.
8:3 All entries carry the option to email the seller for further clarification or description prior to making a final commitment.
8:4 Any and all descriptions by the seller should be accurate and honest.
8:5 Items entered for sale or auction should be exempt of any outstanding finance or any other agreement unless stated.
8:6 Items should be the sole property of the seller and not stolen or obtained dishonestly.

| 9. TRADE DESCRIPTION ACT 1968 |
|
9:1 Vendors are reminded that under the terms of the UK Trades Description Act 1968, the Vendor of any lots to which a false description is applied may be guilty of a criminal offence punishable by fine or imprisonment.

| 10. WARRANTIES AND GUARANTEES |
|
10:1 All descriptions and warranties are those of the seller alone. BuggyMart has no involvement or responsibility for errors and omissions. The buyer should check that descriptions are exactly as advertised and unless expressly stated otherwise you should assume all goods are bought as seen with no warranty. The buyer should be aware at all times.

| 11. PROVISIONAL SALE |
|
11:1 If the reserve price is not met, the highest bid will be submitted to the seller who will then have the option to accept your offer or refuse. You should expect an answer within 24 hours of your auction close.

| 12. LISTING FEES |
|
AUCTION - Items can be placed for auction for free, inclusive of one picture. |
|
ITEMS FOR SALE - Vehicles or items can be placed for sale for free, inclusive of one picture |
|
ITEMS WANTED - Advertise free. Lineage only, no picture. |
|
INVOICES - An invoice will automatically be generated at the time of you placing your listing. You will be given the option to print out and retain this for your records. This is your tax invoice and will include your seller reference number.

| 13. PRIVACY POLICY |
13:1When registering on BuggyMart we collect certain information about you in order to process your registration. This information is securely stored in a database and we will not pass this information on to any
third parties without your permission. The only exception to this is that when you advertise or buy an item on the site then your contact information (name, address, telephone number and email address) will be supplied to the potential registered buyer or seller in order
for the sale to be fulfilled. Unregistered users will not have any access to any information. You may modify any of your personal information via the user Control Panel.
BuggyMart does not store sensitive information on our system.

13:2Cookies : BuggyMart uses small session cookies to store information when you are logged into the site. These temporary session cookies last only as long as you are logged into the site and do not contain any personally identifiable information
about yourself. BuggyMart also optionally uses one cookie to remember your language preference so that we can translate relevant pages and format dates according to your choice. These cookies expire after one year and can be deleted via the user Control Panel.
